Again, if we take the period of the interregnum, when the Church, unconstrained, was left by the State to follow her own laws, the principle of the Church, laid down in 1638, was--"that no person be intruded contrary to the will of the congregation." That is clearly the general principle which is to override all the forms. But when this principle was applied to practice, how stood the law? The form of church government drawn up in 1645, appended to the Confession of Faith, says--"that no man is to be ordained a minister for a particular congregation, if they of that congregation can show just cause of exception against him." The exception then is not conclusive, but only conclusive when it is just. Who are the judges of its justice? The Church at large, through its Ecclesiastical courts. Again, the Church "is to consider the proportion of his gifts in relation to the place." Here again the matter is left to the judgment of the Church at large. Let us however look at the Act of Assembly of 1649, which must be considered on the present question a very decisive authority. The Act of Parliament repeats the great principle, that "the planting of a minister is to be with the consent of the congregation, on whom none is to be intruded against their will." Parliament then left it to the Church to apply this principle after its own way. Does the Church, in its application, lay down the rule as prescribed in 1834? There was nothing to prevent its doing so. There was no constraint laid upon it. There was no shrinking from its own principles. These, on the contrary, were solemnly admitted by Parliament, and sustained, as we know, the most deliberate discussion in the Church itself. It is obvious, therefore, that the act then passed by the Church must have been in acc...
