Therefore, the Committee di-rects the Secretary to defer any final determination on disputed claims until the Comptroller Generals review is completed, and thereafter refer any remaining disputed claims to an Administra-tive Law Judge for resolution, consistent with the procedures of the Debt Collection Act. As a separate matter, the report also notes that the Department is a respondent in a proceeding for judicial re-view of the regulations implementing the Act, on both substantive and procedural grounds. The Committee also directs the Depart-ment to report to the House and Senate Committees on Appropria-tions on the outcome of that proceeding, including its potential ef-fects on the funds and balances still available under the Act.
