Mr. Carver: I would move that Group II. be adopted by the Conference. Nobody has raised a voice against that. Mr. Gray Hill: I beg to second that. The motion was put to the meeting and carried unanimously. The Chairman: In accordance with the course that I suggested, I now pass to Group IV. Perhaps Mr. Carver will move that it be adopted. I gather there are practically no objections in substance to it Mr. Carver: I move that Rules 21, 22, and 23 be adopted. Here we are frankly adopting the English rule. I think we in England have been very conciliatory in adopting foreign views; but in this matter everybody in America, Belgium, and France has agreed that our rule is the best one. Mr. Gray Hill: I beg to second that Rules 21, 22, and 23 be adopted. M. Franck; Mr. President and Gentlemen--I only wish to point out to the meeting what was said as to this matter in the very valuable report of Mr. Ulrich. Mr. Ulrich points out that so far as German law is concerned, it will not be possible to have these rules of double insurance inserted in a policy that would have a valid effect. We in Belgium agreed with the proposal of Mr. Carver. We put our rule aside, our system being, as the meeting is aware, that the first insurance is to hold good. For my part, I do not see that either in France or Belgium there is any objection to a policy which would depart from that legal rule, and adopt Mr. Carvers view; but in German law Mr. Ulrich says that the principle, as far as the second insurance is concerned, is considered as one of public order, and you may not in any way escape the provision of the law as applied there so as to avoid the subject of insurance being covered for more than its value, and whatever you put in the policy would not help it.
